House Financial Services Committee to Consider American Lending Fairness Act

The House Financial Services Committee will consider H.R. 7866, the American Lending Fairness Act of 2026, at a full committee markup on Wednesday, September 16. The bipartisan legislation, introduced by Representatives Warren Davidson (R-OH) and Andy Barr (R-KY), would reaffirm Congress’s original intent under the Depository Institutions Deregulation and Monetary Control Act of 1980 (DIDMCA), preserving the longstanding federal framework that allows state-chartered banks to compete nationally alongside national banks.

“The American Lending Fairness Act provides a clear and necessary reaffirmation of the interstate banking rules that have served consumers and the U.S. banking system for more than 45 years,” said Frank Pignanelli, Executive Director of the National Association of Industrial Bankers (NAIB). “We urge members of the House Financial Services Committee to approve this bipartisan legislation and preserve a competitive national market for credit. Without that clarity, consumers face a patchwork of different state lending requirements that will restrict access to responsible credit, reduce competition and accelerate consolidation.”
